Government Collecting Trinity Guardrail Accident Data

The Federal Government has created an online portal to collect data from the public on Trinity Guardrail Crash Data. On 12/24 a notice was published asking any victims of Trinity Guardrails accidents to submit information including crash photo, police reports, accident reports for the agency to review. In part the notice says “We are seeking crash reports, photographs of damaged ET Plus devices at crash scenes, photographs of vehicles at crash scenes that impacted ET Plus devices, and crash reconstruction reports with corresponding data.”

VIDEO: DuPont victim's daughter hires Beaumont attorney

Family members of the DuPont chemical leak victims are left searching for answers in the wake of tragedy.

Two days after the catastrophe, Jasmine Wise, the daughter of one of the four victims Crystle Wise, hired Beaumont attorney Brent Coon to bring to light what led to employees being exposed to those deadly fumes.

“What she wants to know is what happened and she was very adamant today that she's not really interested in trying to settle,” Coon said. “She wants to know what happened.”

DuPont Plant Gas Leak Kills Four – Attorney Brent Coon files Temporary Restraining Order Against Dupont

On Saturday morning, hazardous gas from the DuPont plant in La Port, Texas, claimed the lives of four workers while injuring one other.  Chrystle Rae Wise, local resident and employee of DuPont, was among those tragically killed on the job when deadly Methyl Mercaptan gas apparently leaked.   Ms. Wise is survived by her only daughter, Jasmine Rae Wise, who stated, "We suffered a devastating loss of losing Crystle Wise during an on the job accident. Our thoughts and deepest sympathies go out to all the other families affected by this tragedy. We hope that closure will come with answers in future reports. Special thanks to all first responders involved in containment and recovery efforts."

Jasmine, a 34 year old resident of Houston,  has retained the Texas based law firm, Brent Coon & Associates, to represent her and the estate.  The firm is widely regarded as one of the top law firms in the country and has extensive history of litigation in the petrochemical industry.   Several years ago, Brent Coon led a grueling fight against  British Petroleum following the 2005 Texas City plant explosion that took the lives of 15 workers, including James and Linda Rowe, the parents of BCA client Eva Rowe.  His firm reached a landmark settlement on behalf of Ms. Rowe that included $44 million dollars of charitable contributions dedicated to further worker’s safety and burn treatment protocols.  Hundreds of additional claims were ultimately resolved after months in trial. Brent worked directly with multiple investigative agencies, including the U.S. Chemical Safety & Hazard Investigation Board (CSB) and the Department of Justice, and the incident and ensuing  litigation resulted in sweeping reforms to the petrochemical industry.

Sunday, U.S. Chemical Safety  & Hazard Investigation  Board spokesman Sandy Gilmour stated a seven-person investigative team led by the agency's director, Daniel Horowitz, had already arrived at the Dupont plant.  Coon’s firm has already been in contact with the agency and advised they will again share whatever evidence is uncovered. 

In addition to filing a TRO to preserve the evidence while investigating the cause of the leak Saturday, Mr. Coon said his law firm has filed suit on behalf of Ms. Wise.  “Our first goal is to preserve evidence and initiate our own independent investigation of what transpired. Internal company investigations are usually self-serving and protecting in nature and unreliable, typically pointing the finger at low level employees when the incidents are most often caused by management driven shortcuts”. 

Brent Coon personally penned the “Remember the Fifteen” Bill, introducing it at the Texas State Capitol in efforts to make an entire industry more accountable for its actions.  The firm continues to undertake a high profile position in various petrochemical industry cases and is the largest stakeholder in the BP oil spill litigation, representing over 10,000 clients from Florida to Texas.

“Once again,” said Coon, “we see these companies place their workers in undue harm to pad the bottom line.  And this ‘profits over people’ mentality continues to cause unnecessary and unjust accidents resulting in serious injury or death.”  Mr. Coon envisions pursuing a similar course of action against DuPont.  “We will not only seeking justice for Jasmine and the others harmed from this incident, but  we will keep  the heat on an entire industry.  Hopefully we can use this tragedy as an opportunity to renew our call-to-action for the creation of a state-based OSHA agency for Texas to oversee safety issues at industrial workplaces.” said Coon.  “Texas has the highest workplace injury levels in the country, and this industry needs much greater oversight of their safety and health programs.  It is frankly unconscionable that a company as sophisticated as Dupont would allow any work to be done in a manner that would result in four workers being gassed to death at their facility. Proper protective gear should always be mandated  and utilized when working in any conditions that put a worker at risk to exposure to poison gas.   Unfortunately, many companies still find the use of canaries as a cheaper alternative”.

GM Recall Death Lawsuit Filed in Louisiana

A lawsuit was filed on Tuesday morning against General Motors on behalf of a Louisiana women who’s mother was killed while driving her General Motors vehicle. On June 13, 2013 wreck, Amy Smith’s, mother, Linda Hilbert, was driving her 2007 Chevrolet HHR when left the roadway and rolled over several time before coming to rest on its side. The vehicle suffered severe damage to the left front side and damage to the roof. Despite being properly belted in the driver’s seat, Linda Hilbert was pronounced dead at the scene by the Coroner of Tangipahopa Parish. The lawsuit alleges the Chevy Cobalt’s ignition switch defect caused loss of control of the vehicle and caused the fatal crash that took this woman’s life.

Non-PSC attorneys feel left out of Deepwater Horizon settlement process

NEW ORLEANS – A group of about 100 attorneys and accountants frustrated by the slow claims process in the Deepwater Horizon oil spill case met in a downtown New Orleans hotel Monday to discuss how to jumpstart what appears to have become a hopelessly stalled process.

The meeting was coordinated by Brent Coon & Associates (BCA), a Beaumont, Texas law firm that represents 5,000 claimants. It was attended mainly by representatives of law firms who are not members of the Plaintiff’s Steering Committee (PSC) – the group of lawyers who brokered the massive settlement that arose from the BP oil spill in 2010.

Some plaintiff attorneys say the settlement, beset by allegations of fraud and mismanagement, has become unworkable for those claimants who are not represented by PSC lawyers. The PSC firms, which stand to split a collective $660 million fee for overseeing the settlement, have been accused by some non-PSC lawyers of manipulating the claims process for their own benefit.

While Coon and the others gathered at the meeting were vocal critics of BP for doing its own part to stall the claims process, rifts are appearing within the trial attorneys ranks. Several attorneys on hand for the meeting complained that the PSC firms – which are sworn to represent the rights of all claimants – have disregarded their complaints that the settlement process is at a virtual standstill.

“Our steering committee has not done a very effective job communicating those concerns, either back to the court or back to the claimants,’’ Coon said. “[Our claimants] have no reasonable expectation of getting paid anytime soon; it may be years.’’

July 29th, 2014 - BCA Verdict and Settlement Announcement

Joshua Dorman, a Union Pacific Railroad employee  was injured while driving a company truck when the brakes failed causing the truck to roll over. Mr. Dorman suffered injuries to his cervical spine and shoulder when he was ejected from the truck.  Joshua Dorman’s lawsuit was settled last week, terms of the settlement are confidential. The plaintiffs argued that Union Pacific Railroad Company failed to properly maintain the vehicle after the employee notified his supervisor of the brake defect.

While the settlement terms will remain confidential, Mr. Dorman is very pleased with the results of the case. Attorney Paula Rasmussen, of Brent Coon and Associates stated that she was both proud to represent Joshua Dorman and also pleased with the results of the settlement.  Paula Rasmussen stated, “We are so proud of the courage in which Joshua showed throughout the entire process and are pleased that their efforts were richly rewarded today.”

Attorney Jack Feeney represented Union Pacific Railroad Company in this lawsuit which was filed in Kern County Superior Court.

A new study published in the JAMA Internal Medicine indicates there is a potential increased risk of  melanoma for Viagra users. The study indicates that men who use Viagra may have an increased risk of melanoma up to 84%. The FDA has not yet made any comment regarding investigations into this dangerous potential Viagra Side Effect. The widespread use of Viagra in the United States is so large that if lawsuits do move forward it could create a massive Viagra Class Action lawsuit.

Breaking: New General Motors Recall of 1.3 Million due to Steering Issues.

On Monday March 31st General Motors Announced another recall. This recall is over faulty steering issues in a number of GM vehicles. Some of the models overlap from the previous recall of cars of faulty ignition switches. The list of vehicles in this recall include Saturn Ion, Chevrolet HHR, Chevy Cobalt, 2004 - 2010 Chevrolet Malibu, Malibu Maxx, Saturn Aura, and Pontiac G6 models. In some cases drivers will be heading back to the dealership to address 2 seperate issues in these General Motors vehicles.

The Great Invisible - BP Oil Spill Documentary Film

Over the past two years, Brent Coon and Associates has spent a great deal of time with a documentary film crew providing interviews and helping with research for a film they were creating about the 2010 Deepwater Horizon Explosion and ensuing oil spill. That film, The Great Invisible, is now set to premier this weekend at the South By Southwest Film Festival in Austin, TX.
